What is Probate?

Probate is the legal process of proving and registering a deceased person’s will in court. It grants the executor the authority to manage and distribute the deceased's estate according to their will. If there is no valid will, the next of kin may need to apply for Letters of Administration instead. 

What is a Transmission Application?

A Transmission Application is used to transfer property from a deceased person's name to an executor, administrator, or beneficiary. It is different from a regular property transfer because it does not involve a sale or commercial transaction but rather a legal recognition of ownership due to death.


Types of Transmission Applications:

  1. To Executor/Administrator: If the property is part of a deceased estate, it must first be transmitted to the executor or administrator before it can be distributed to beneficiaries. 
  2. To Beneficiary: Once probate or administration is granted, the property can then be transferred directly to a beneficiary under the terms of the will or intestacy laws.
